SB475 - Expungement of Record when Not Guilty or Pardoned - with three amendments
Amendment 1: Page 27, line 27 delete who and insert for other than law enforcement purposes intentionally
Page 28, after line 3, insert new Section 12 and renumber subsequent sections accordingly
Section 13. Nothing in this act shall prohibit a law enforcement agency, the Alabama Department of Forensic Sciences, or a prosecuting attorney from maintaining an investigative file up to 10 years following an order of expungement. The file may include evidence, photographs, exhibits, or any other information in document or electronic form.

Amendment 2: Page 12, after line 12, insert a new subparagraph 52 as follows and renumber subsequent subparagraphs accordingly: 52. Sexual abuse in the second degree as proscribed by Section 13A-6-67, Code of Alabama 1975.

Page 17, line 6, after "subdivision" delete the figure "21" and insert in lieu thereof the following: (20)
Page 27, lines 9-15, delete Section 9 in its entirety and renumber subsequent sections accordingly.
Page 27, line 25, after "individual" insert the following: that is not a law enforcement official or criminal justice agency official
Page 28, after line 3, insert the following: Section 12. Nothing in this act shall prohibit a law enforcement or criminal justice agency or official or a prosecuting authority from maintaining an investigative file, which may include evidence, photographs, exhibits, or information in documentary or electronic form. The expunged information shall be kept confidential, shall be exempt from disclosure under Section 36-12-40, Code of Alabama 1975, and may only be used for law enforcement purposes.

Amendment 3: Page 16, line 21, after "area" insert the following: or have any conviction for operation of a vehicle for which a commercial driver's license was required.
Page 20, line 6, after "a." delete "Six hundred dollars ($600)" and insert in lieu thereof the following: Five hundred dollars ($500)
Page 20, line 8, after "b." delete "Two hundred dollars ($200)" and insert in lieu thereof the following: One hundred dollars ($100)
Page 20, after line 14, insert the following: One hundred dollars ($100) to the Department of Public Safety
Page 20, line 19, after "a." delete "Four hundred fifty dollars ($450)" and insert in lieu thereof the following: Three hundred dollars ($300)
Page 20, after line 27, insert the following: e. Seventy-five dollars ($75) to the Alabama Criminal Justice Information Center. f. Seventy-five dollars ($75) to the Department of Public Safety.
